This policy explains how Femily Limited collects, uses and protects your personal data when you visit femily.co, when you buy Femily Pro or Femily VIP, and while you are a member, and the rights you have over that data.

It is written in plain language. If anything is unclear, contact us using the details in the final section and we will be glad to help.

Question for review

Unconfirmed. This policy is a draft. Every block marked like this one is a question that has to be answered before the page is public, and Michael Rock answers it. The draft describes what happens when somebody buys, and it does not describe a sign-up form, because this website has none.

1. Who we are

Femily Limited is the data controller responsible for your personal data. We are a company registered in Ireland, operating a performance coaching brand for female athletes.

2. What this policy covers

This policy covers personal data we collect when you:

  • visit femily.co;
  • buy Femily Pro or Femily VIP through our checkout;
  • take part in Femily Pro or Femily VIP as a member;
  • contact us directly by email.

It does not cover third-party websites we link to, including the checkout and community platform we use. Those services have their own privacy policies, and we encourage you to read them.

3. The personal data we collect

We collect different categories of data depending on how you interact with us, and we only collect what we need.

3.1 When you visit femily.co

This website has no forms and no account. You can read every page of it without telling us who you are.

We use Vercel Web Analytics to understand how the site is used. It gives us aggregate figures, for example how many people visited a page and where they came from, and it is designed by its provider to work without cookies and without tracking you across other websites. It does not build a profile of you and is not used for advertising.

When you press a button that leads to our checkout, we record that a checkout button was pressed, which product it was for, and which part of the page it was on. That record is not tied to you or to your device, and it is used only to see which parts of the page lead people to the checkout.

3.2 When you buy Femily Pro or Femily VIP

Our checkout runs on Circle, and payments are processed by Stripe. When you buy, Circle and Stripe collect the information needed to take your payment and give you access, which includes your name, your email address and your payment details. Payment card details are handled by Stripe and are never seen or stored by us.

Unconfirmed. Exactly which fields the Circle checkout collects, and which of them Femily can see afterwards (name, email address, and whether anything else such as a phone number or a sport is asked for). Michael confirms from the Circle checkout settings.

3.3 While you are a member

Your community profile. Femily Pro includes a private community on Circle. Your profile there, which includes your name and anything you choose to add to it, and anything you post, is visible to the other members of that community and to your coaches.

Your training. Your programming is delivered through BridgeAthletic. To deliver it, BridgeAthletic holds an account for you and the training you record in it.

Question for review

Unconfirmed. What personal data the BridgeAthletic account holds: whether it is created from your name and email address alone, and whether the training you log there (sessions completed, loads, notes) is stored against you and visible to your coaches. Michael confirms.

Femily VIP. VIP includes a weekly check-in with your coach and direct contact between sessions. What you tell your coach in those conversations is used to write and adjust your programme.

Question for review

Unconfirmed. Whether coaching conversations collect information about your health, such as injuries, illness, menstrual cycle or pregnancy, and if they do, on what basis it is processed. Information about your health is special category data under the GDPR and needs an explicit basis, usually your explicit consent, which this policy does not yet ask for. Michael confirms with Lucy and Orlaith what a check-in actually asks, and how it is recorded.

3.4 When you email us

If you email us directly, we receive your email address and whatever information you choose to include in your message.

4. How we use your data, and our lawful basis

Data protection law requires us to have a lawful basis for using your personal data. The bases we rely on are set out below.

5. Marketing emails

This website has no sign-up form, and visiting it does not add you to any list.

Emails about your subscription, such as a receipt, a change to your access or a change to what you have bought, are part of the service and are not marketing emails.

Question for review

Unconfirmed. Whether buying Femily Pro or Femily VIP adds you to our marketing list in Loops, and if it does, on what basis: a consent box at the checkout, or the existing-customer exemption in Irish law for marketing similar products to a customer who was given the chance to opt out when their details were collected. The two need different wording here and different set-up in Circle and Loops. Michael confirms what happens to a buyer's email address today, and decides which it is to be.

If we do send you marketing emails, every one of them will contain an unsubscribe link, and you can also email admin@femily.co to be removed at any time. Withdrawing consent does not affect anything we did with your data before you withdrew it, and it does not affect your subscription.

6. Who we share your data with

We do not sell your personal data, and we never will. We share it with a small number of service providers who help us run Femily. These providers act on our instructions and are bound to protect your data. They are:

Question for review

Unconfirmed. Whether this list is complete. In particular: whether our accountant receives anything that identifies individual customers rather than totals; whether email to admin@femily.co is handled by a provider who should be listed; and whether any automated Instagram messaging tool is still in use. Michael confirms.

We may also share your data where we are legally required to, for example in response to a valid request from a public authority, or to establish or defend legal claims.

7. Where your data is processed

Some of our service providers are based outside the European Economic Area, including in the United States. Where your personal data is transferred outside the EEA, we make sure it is protected by an appropriate safeguard recognised under data protection law. In practice this means the provider is covered by the European Commission's Standard Contractual Clauses, the EU-US Data Privacy Framework, or another lawful transfer mechanism.

8. How long we keep your data

We keep your personal data only as long as we need it.

  • Your membership and purchase records: for as long as you are a member, and afterwards for the period required to meet our legal, accounting and tax obligations.
  • Your community profile and posts: for as long as you are a member.
  • Your training records: for as long as you are a member.
  • Marketing contact details: until you unsubscribe or ask us to remove you. We may keep a minimal record of your request so that we do not contact you again in error.
  • Email correspondence: for as long as needed to deal with your query and to keep a reasonable record of our communications.

Question for review

Unconfirmed. What happens to your community profile, your posts and your training records when you cancel: whether Circle and BridgeAthletic delete the account, keep it dormant, or keep it until we remove it, and how long we intend to keep any of it after you leave. Michael confirms, and the three bullets above change to match.

You can ask us to delete your data at any time by emailing admin@femily.co. Section 10 explains your rights.

9. Cookies and analytics

femily.co sets no cookies, and does not ask you to accept any. The analytics described in section 3.1 work without them.

Our checkout and our members' community run on Circle, and payments run on Stripe. Those services set their own cookies on their own pages, under their own privacy policies.

If we ever introduce cookies or tracking on femily.co that require your consent, we will update this policy and ask for your consent before they are used.

10. Your rights

Under the General Data Protection Regulation and Irish data protection law, you have the following rights over your personal data:

  • The right to be informed about how we use your data, which is the purpose of this policy.
  • The right of access to the personal data we hold about you.
  • The right to rectification if any data we hold about you is inaccurate or incomplete.
  • The right to erasure of your personal data in certain circumstances, sometimes called the right to be forgotten.
  • The right to restrict processing of your data in certain circumstances.
  • The right to data portability, allowing you to obtain and reuse your data.
  • The right to object to our processing of your data, including objecting to marketing at any time.
  • The right to withdraw consent at any time, where we are relying on your consent.

You will not be charged for exercising your rights, and we will respond within one month. We may ask you to confirm your identity before we act on a request, so that we do not disclose your data to anyone else.

11. Age

Question for review

Unconfirmed. Whether Femily Pro and Femily VIP are sold to players under 18. Club ladies football and camogie squads include teenagers, and if a player under 18 can buy, this policy has to say what is asked of a parent or guardian and the checkout has to ask it. Michael confirms with Lucy and Orlaith, and this section is written once he has.

12. How to exercise your rights, and how to complain

If you are not satisfied with how we have handled your data or your request, you have the right to lodge a complaint with the Irish data protection authority:

13. Changes to this policy

We may update this policy from time to time, for example if we change how we work or introduce new services. When we make a significant change, we will update the effective date at the top of this policy and, where appropriate, let you know by email.
